Mandate and Fees

Clients will typically enter into a “Fee Agreement” with us where the scope of the lawyer’s activity will be defined and the fees agreed.  If the mandate is providing for work in front of courts or administrative bodies, the client will be additionally required to sign a power of attorney in favour of its lawyer in order to be represented in court.

The Fee Agreement will determine the type of fees and expenses to be paid, the periodicity of invoicing of such fees and expenses as well as the level of advance payments, if any.  We will endeavour a Fee Agreement that will take into account all aspects of the client and the case and which appears to be fair and appropriate under the circumstances.

As a rule, we will invoice our work on a time spent basis.  We will fairly determine the level of the hourly rate by taking into account the nature of the mandate.  Our fees are net of value added tax of currently 8%, which shall be added to the fees as appropriate under VAT regulations.  

We may also enter into a Fee Agreement that will fix a success fee in addition to a reduced hourly base fee, whereby such success fee will be paid upon meeting pre-determined objectives only.  If the pre-determined objectives are not met, the client will have to pay the hourly base fee only.  

If appropriate, we are also willing to charge our fees in application of the schedule of official tariffs in cases before courts and public authorities.  As a matter of law, the schedule of official tariffs will always apply in cases before courts and public authorities if no agreement on fees could be reached with the client.  

Exceptionally and provided the scope of work is clearly identified, we may also enter into a lump sum fee arrangement.
